1.Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Blue Tempo mobile app, website at bluetempo.app, and related services (together, the "Service"), provided by APG Technology LLC ("APG Technology," "Blue Tempo," "we," "us," or "our"). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms, and "you" refers to that business.
2.Definitions
- "Administrator" means a user who creates or manages a Blue Tempo workspace, such as a business owner or manager.
- "Teammate" means a user invited to a workspace to track time.
- "Customer Data" means the information you and your Teammates submit to the Service, including time entries, project details, hourly rates, and location punches.
- "Subscription" means a paid plan that grants access to the Service.
3.Accounts & eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. Notify us promptly at contact@goapgtech.com of any unauthorized use. Each Teammate receives their own login, and Administrators are responsible for managing access within their workspace.
4.Subscriptions & pricing
Blue Tempo is offered on the following monthly plans. Every plan includes the full feature set; plans differ only by the number of Teammates permitted.

Prices are in U.S. dollars and exclude any applicable taxes, which you are responsible for paying. We may change our prices or plans; if we change the price of your Subscription, we will give you advance notice, and the new price will apply to your next billing cycle. Continued use after a price change constitutes acceptance of the new price.
5.Free trial
We offer a 14-day free trial so you can evaluate the Service. Unless you cancel before the trial ends, your Subscription may begin automatically and you will be charged the applicable plan fee using the payment method on file. We may modify or discontinue trial offers at any time. Only one trial is available per business unless we agree otherwise.
6.Billing, renewals & cancellation
- Billing. Paid Subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the recurring fee until you cancel.
- Auto-renewal. Subscriptions renew automatically each month unless cancelled before the renewal date.
- Cancellation. You may cancel at any time from your account settings. Cancellation stops future charges and takes effect at the end of the current billing period; you retain access until then.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused time.
- Failed payments. If a charge fails, we may suspend or downgrade your access until payment is resolved.
- App-store purchases. If you subscribe through the Apple App Store or Google Play Store, billing, renewals, and cancellations may be handled by that store under its own terms.
7.Acceptable use
You agree not to, and not to permit others to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Falsify time records or use the Service to defraud any person;
- Access another user's account or data without authorization;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Interfere with, disrupt, or overload the Service, or bypass its security or access controls;
- Upload malicious code or infringe the intellectual property or privacy rights of others; or
- Resell, sublicense, or provide the Service to third parties except as expressly permitted.
8.Time & location tracking responsibilities
Blue Tempo records time and job-site location to help you manage your workforce. You are solely responsible for using the Service in compliance with all applicable laws, including wage-and-hour, labor, employee-monitoring, biometric, and privacy laws.
- You are responsible for notifying your Teammates that their time and location are tracked and for obtaining any consents required by law before enabling tracking.
- You are responsible for correctly configuring pay rates, project settings, and tracking radii, and for reviewing and verifying records before relying on them for payroll or legal purposes.
- Blue Tempo provides tools to record hours but does not provide legal, tax, payroll, or accounting advice, and is not your payroll processor or employer of record.
9.Customer data & ownership
As between you and us, you own your Customer Data. You grant us a limited, non-exclusive license to host, process, and use Customer Data solely to provide and improve the Service and as described in our Privacy Policy. You represent that you have the rights and permissions necessary to submit Customer Data, including information about your Teammates. We maintain reasonable backups but you are responsible for retaining your own copies of important records, including exported timesheets.
10.Intellectual property
The Service, including its software, design, logos, and the "Blue Tempo" name and branding, is owned by APG Technology LLC and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your internal business purposes during your Subscription. All rights not expressly granted are reserved. You may submit feedback, and we may use it without obligation to you.
11.Third-party services
The Service relies on and may integrate with third-party services, including Stripe, cloud hosting providers, analytics providers, and the Apple App Store and Google Play Store. Your use of those services may be subject to their own terms, and we are not responsible for third-party services or their availability.

You agree to indemnify and hold harmless APG Technology LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Customer Data, your violation of these Terms, or your violation of any law or the rights of any third party, including your Teammates.
15.Term & termination
These Terms apply while you use the Service. You may stop using the Service and cancel your Subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. Upon termination, your right to use the Service ends. You may export your Customer Data before termination; after a reasonable period, we may delete it. Sections that by their nature should survive termination will survive.
16.Dispute resolution & arbitration
Informal resolution. Before starting an arbitration, you agree to first contact us at contact@goapgtech.com and give us 30 days to resolve the dispute informally.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding arbitration administered by a nationally recognized arbitration provider under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be governed by the Federal Arbitration Act and will take place in or near Greene County, Georgia, or be conducted remotely, at the arbitrator's discretion.
Class-action waiver. You and APG Technology agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
Opt-out. You may opt out of this arbitration agreement by sending written notice to contact@goapgtech.com within 30 days of first accepting these Terms. If any part of this Section is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable, this entire arbitration Section will be void.
17.Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Subject to the arbitration provisions above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction.
18.Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after an update means you accept the revised Terms.
19.General
These Terms and the Privacy Policy are the entire agreement between you and APG Technology LLC regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
